Highcross Grand Opening Sweepstake Terms and Conditions

  1. NO PURCHASE NECESSARY.
  2. This prize draw is open to all UK residents aged 18 or over, excluding employees of Apple Retail UK Limited or its affiliated companies (“Apple”), their immediate families, or anyone professionally associated with this prize draw and their immediate families. Only one entry per person is allowed.
  3. To enter this prize draw, entrants must complete the entry form and place it in the Sweepstakes box located at the Apple Store, Highcross, Upper Mall, Highcross, Leicester, LE1 4FT.
  4. By submitting your entry form, you consent to the Promoter using your registration details for the purpose of fulfilling this prize draw. All information will be held in accordance with the Promoter’s Privacy Policy and its website terms of use (see www.apple.com/uk/legal/privacy).
  5. The closing date for receipt of in-store entry forms is 7 September 2008. Postal entries must be received by 10 September 2008.
  6. No responsibility is accepted for late, lost, delayed, damaged, illegible or incomplete entry forms, which shall be disqualified at the discretion of the Promoter. Proof of posting will not be accepted as proof of delivery.
  7. The winners will be chosen at random on or about 11 September 2008. The Promoter’s decision is final and no correspondence shall be entered into.
  8. The winners shall be notified by email or telephone on or about 15 September 2008. To claim the prize, the winners must send an email to highcross@apple.com or call 0116 201 1900 on or before 22 September 2008.
  9. If the Promoter does not receive email or telephone confirmation from the winner or cannot contact the winner for any reason by 20 October 2008, or if the Promoter has reasonable grounds for believing that an entrant has contravened any of these Terms and Conditions, the Promoter reserves the right to select an alternative winner.
  10. The prizes are: Grand Prize consists of 1 x Black 13-inch 2.4GHz Intel Core 2 Duo MacBook, 1 x one-year One to One membership, 1 x 4GB silver iPod nano, 1 x copy of iWork ’08, 1 x one-year membership to MobileMe and 1 x AppleCare Protection Plan for MacBook. (Total approx. retail value of more than £1,400.) Second Place Prizes: 10 x one-year One to One membership (approx. retail value of £79 per membership.)
  11. The prizes are as stated and are non-transferable. No cash alternatives will be offered except, if, due to circumstances beyond the Promoter’s control, the Promoter is unable to provide the stated prizes, the Promoter reserves the right to award an alternative prize of equal or greater value. The prizes are subject to the standard terms and conditions accompanying such product or service.
  12. Entrants agree to take part in additional unpaid publicity (including photographic shoots and interviews) accompanying or resulting from this prize draw should the Promoter require them to do so.
  13. The Promoter and its affiliates shall be entitled (but not obliged) to use the name, biography and likeness of the winner in connection with this prize draw for any advertising, publicity and editorial purposes in any media throughout the world, without any additional compensation, unless prohibited by law.
  14. To obtain the names of the winners, please send an email to highcross@apple.com with “GO Sweepstakes” in the subject heading, or a stamped addressed envelope to the Promoter at Apple Store, Highcross, Upper Mall, Highcross, Leicester, LE1 4FT within one (1) month of the closing date.
  15. BY ENTERING THIS PRIZE DRAW, ENTRANTS HEREBY AGREE TO RELEASE, INDEMNIFY AND HOLD HARMLESS APPLE RETAIL UK LIMITED AND ITS AFFILIATES, PARENTS, SUBSIDIARIES, AGENTS, EMPLOYEES, OFFICERS, DIRECTORS AND SHAREHOLDERS FROM ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY OR DEATH RESULTING FROM PARTICIPATING IN THE SWEEPSTAKES OR FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY. THIS LIMITATION IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. THE PROVISIONS REGARDING IMPLIED WARRANTIES ARE VOID IN SOME JURISDICTIONS WHERE IMPLIED WARRANTIES ARE PROSCRIBED BY LAW, SO YOU SHOULD DETERMINE WHETHER SUCH EXCLUSIONS APPLY TO YOU.
  16. By entering this prize draw, entrants agree to be bound by these Terms and Conditions and by any other requirements set out in the promotional material, which may be amended or varied at any time by the Promoter.
