Apple Retail India Sales Policy

Thanks for shopping at Apple. We appreciate the fact that you like to buy the cool stuff we build. We also want to make sure you have a rewarding experience while you’re exploring, evaluating, and purchasing our products, whether you’re in an Apple Retail Store, on apple.com/in or on the phone with the Apple Contact Center. (To make it visually easier on both of us, we’ll refer to them collectively as the “Apple Store” in this policy.) The Apple Online Store is operated by Apple India Private Limited which is a company incorporated in India with its registered office at 19th Floor, Concorde Tower C, UB City No. 24, Vittal Mallya Road, Bangalore, Karnataka, 560001, India.

As with any shopping experience, there are terms and conditions that apply to transactions at an Apple Store. We’ll be as brief as our attorneys will allow. The main thing to remember is that by placing an order or making a purchase at an Apple Store, you agree to the terms set forth below along with Apple’s  Privacy Policy and Terms of Use.

Returns and Exchanges

Products purchased at the Apple Store in India cannot be refunded or exchanged.

If you believe that your new Apple product is defective please contact Apple Store Customer Service to discuss your options.

Wireless Services

Some Apple products utilise wireless services that may incur extra costs and are governed by the terms of a separate agreement between you and your selected wireless service provider.

Additional Apple Product Terms

Apple provides a one-year limited manufacturer warranty against defects in materials and workmanship for any new Apple-branded product. The applicable warranty terms and conditions can be reviewed at https://www.apple.com/in/legal/warranty/and are also contained in your Apple hardware box. Apple's one-year manufacturing warranty is granted separately from and in addition to any consumer protection rights applicable under Indian Consumer Law.

Making unauthorised modifications to the software on an iPhone violates the iPhone software license agreement. The common term for modifying an iPhone is jail-breaking, with a particular emphasis on the second part of that term. That’s why we strongly, almost emphatically, recommend that you do not do so. Should you be unable to use your iPhone due to an unauthorised software modification, its repair will not be covered under the warranty.

Pricing and Price Reductions/Corrections

Apple reserves the right to change prices for products displayed at the Apple Store at any time, and to correct pricing errors that may inadvertently occur. Any price changes will not affect an order that has already been accepted by Apple. In the event of a pricing error, we will notify you of the error and allow you to either proceed with the transaction at the correct price or cancel your order at no cost to you.

Should Apple reduce its price on any Apple-branded product within 14 calendar days from the date you receive your product, feel free to visit an Apple Retail Store or contact the Apple Contact Center on 000800 040 1966 to request a refund or credit of the difference between the price you were charged and the current selling price. To receive the refund or credit you must contact Apple within 14 calendar days of the price change. Please note that this excludes limited-time price reductions, such as those that occur during special sales events.
Price protection is only available for up to 10 units of a particular product. Additionally, we may require that you have the product with you or otherwise have proof of possession when requesting price protection.

Prices shown are in Indian rupees Rs. If you are paying for your order with an international credit card, please note that the purchase price may fluctuate with exchange rates. In addition, your bank or credit card issuer may also charge you foreign conversion charges and fees, which may also increase the overall cost of your purchase. Please contact your bank or credit card issuer regarding these fees.

Payment Options: 

The Apple Store offers various payment methods. Further information on payment can be found in the Payment & Pricing section of the Help page located at https://www.apple.com/in/shop/help/payments.

If you are paying by credit card, when you submit your order, we may block up to the total amount of the order on your credit card. If we do not receive authorisation from your credit card issuer, we will inform you so that you can provide us with another payment method. Your credit card will be charged once we accept your order.

We reserve the right to verify the identity of the credit card holder by requesting appropriate documentation.

All information provided by you will be treated securely and strictly in accordance with the applicable data protection laws.

Order Acceptance/Confirmation

Apple may, in its sole discretion, refuse or cancel any order and limit order quantity. Apple may also require additional qualifying information prior to accepting or processing any order. Once we receive your order that was placed on apple.com/in or through an Apple Contact Center, we’ll provide you with an email order confirmation. Your receipt of an order confirmation, however, does not signify Apple’s acceptance of your order, nor does it constitute confirmation of our offer to sell; we are simply confirming that we received your order. The Apple Store reserves the right at any time after receiving your order to accept or decline your order for any reason. If Apple cancels an order after you have already been billed, Apple will refund the billed amount.

To place an order for products or services at the Apple Store, you can visit the store website at https://www.apple.com/in, and then simply add the products you wish to your shopping bag, check out (using your chosen payment method) with your Apple ID or as a guest customer, and have your items shipped to you or to a person designated by you. Within a few minutes after we receive your order, we’ll email and SMS you an order confirmation. Once we have processed your order and prepared it for shipping, we will send you an email and SMS stating that we have accepted your order, which will include the shipment details (the “Shipment Notification Email”). In most cases, this will be within twenty-four hours for items that are in stock. Once we have sent and you have received the Shipment Notification Email, Apple will have formed a contract with you (we will include the key terms of the contract in this acceptance email). All that remains at that point is for us to deliver the product(s) to you, which we will do straightaway so you can begin enjoying the amazing item(s) you purchased at the Apple Store.

Shipping & Delivery

Standard and express delivery options are available through the Apple Online Store and by speaking with our Apple Contact Centre. The standard delivery is free of charge for any order exceeding a certain amount. For orders below this amount or for express delivery, shipping fees will apply. Please visit https://www.apple.com/in/shop/help/shipping_delivery for the current shipping rates and fees. Each item in your order will ship as it becomes available. Orders will not be accepted and products will not be delivered to any address outside of the covered delivery PIN codes in India. Please check your delivery PIN code is covered before ordering.

Please review the Shipping & Pickup page to learn about how and when you will receive the products you purchased from us. Since the actual delivery of your order can be impacted by many events beyond Apple’s control once it leaves our facilities, we will notify you of any significant delays, and work with you to ensure a smooth delivery. As Apple takes care of the dispatch of the products you purchase on the Apple Store, the risk of loss or damage to the product(s) shall pass to you when you, or a person designated by you, acquires physical possession of the product(s).

In-Store Pickup and Return

Apple offers in-store pickup for many of the items available on apple.com/in. Certain products and payment methods, however, may not qualify for in-store pickup. Only you or the person designated by you may pick up the item(s) purchased. A government-issued photo ID and order number will be required for pickup. Apple will notify you when your order is ready and the date by which you need to pick up your items. We’ll also send you a reminder or two, just in case it slips your mind. If you select in-store pickup, you may designate a third party to pick up your order. You must provide the name and email address of the third party. Please note that certain products and payment methods are not eligible for in-store pickup by a third party. The third party will need to bring a government issued photo ID and order number for pickup. Apple is not responsible for actions taken by the third party once your item(s) have been picked up.

Consumers Only

The Apple Store sells and ships products to end-user customers only, and we reserve the right to refuse or cancel your order if we suspect you are purchasing products for resale.

Product Availability and Limitations 

Given the popularity and/or supply constraints of some of our products, Apple may have to limit the number of products available for purchase. Trust us, we’re building them as fast as we can. Apple reserves the right to change quantities available for purchase at any time, even after you place an order. Furthermore, there may be occasions when Apple confirms your order but subsequently learns that it cannot supply the ordered product. In the event we cannot supply a product you ordered, Apple will cancel the order and refund your purchase price in full.

GST

Providing correct GSTIN information is your sole responsibility. Providing GSTIN details of any third person who is not a party to the order placed by you is an offence under GST law.

Please note that the GST invoice shall contain the GST information provided by you like GSTIN, business entity name, billing address, shipping address etc. You should ensure that these details are accurate. Apple cannot accommodate requests for any revisions to GST Invoices.

Kindly provide the address which is mentioned as the registered place of business as per the records of the GST authority. Providing the wrong address (which is not mentioned on your GST certificate) may result in GST loss to you.

Availment of input tax credit is subject to provisions of GST Act and rules. Apple will issue a GST compliant Tax invoice for your purchase. Apple is not liable in any manner whatsoever in relation to the GST Invoice or any input tax credit associated therewith.

Total tax charged includes all transaction tax (GST) but excludes Tax Collection at Source (TCS) which will be charged separately if applicable. As per section 206(C)1H of the Income-tax Act, 1961 (“the Act”), TCS would be charged / collected at the applicable rates (0.1% /5%) on consideration from sale of goods in excess of the prescribed threshold limit (i.e. INR 50 lakhs or any other limit as prescribed by the Government) in aggregate in a financial year. Apple, in accordance with the provisions of the Act, reserves the right to charge / collect TCS in addition to the price already paid at the time of placing an order.
