Apple Account Associated Balance; Redemption; Add Funds.

You may add funds to the balance associated with your Apple Account (“Account”) to establish an “Associated Balance” by using any of the payment methods on file with the iTunes Store, App Store, Apple Music and other services (“Services”) offered or supported by Apple Distribution International Ltd. (“Apple”) and use such Associated Balance to directly purchase from the Services. You may also link Gift Cards or Codes with your Account to top up your Associated Balance. Terms and conditions related to Gift Cards and Codes are available here: https://www.apple.com.cn/legal/internet-services/itunes/giftcards/cn/terms.html. Your Associated Balance represents the balance of all value that has been associated with your Account. When you have a balance with your Account, purchases from the Services will first be deducted from your Account. Any unused balance will remain associated with your Account. If a purchase exceeds your Associated Balance, you will be asked to pay with another payment method. If your new payment method cannot cover the remaining amount, the transaction may be canceled.

APPLE Account: Use of an Associated Balance requires an Apple Account and acceptance of the Services terms and conditions. An Apple Account is the account you use to access the Services.

Use of Associated Balance: You may top up your Associated Balance by redeeming physical or digital Gift Cards and Codes into your Associated Balance or by adding funds to your Associated Balance using any of your payment methods on file.

You agree to not use your Associated Balance in a manner that is misleading, deceptive, unfair, or otherwise harmful to Apple or its customers. We reserve the right, without notice to you, to void or deactivate your Associated Balance (including a portion of your Associated Balance) without a refund, suspend or terminate customer accounts, suspend or terminate the ability to use the Services, cancel or limit orders and bill alternative forms of payment if we suspect any portion or the whole of your Associated Balance was obtained, used, or applied to an Apple Account fraudulently, unlawfully, or otherwise in violation of these terms and conditions.

If you use the payment method on file with the Services to add funds to your Associated Balance, prior to charging the payment method on file, an authorization will occur for the amount of your purchase.

Restrictions: Your Associated Balance is not redeemable for cash and cannot be returned for a cash refund or refunded to the original tender (except as required by law, under which circumstances such refund will be interest free); exchanged; resold; or used to purchase Gift Cards and Codes; used to purchase AppleCare+ plans; used for purchases on the Apple Online Store; or used in Apple Retail Stores. Your Associated Balance can only be used to purchase content or other services from the Services available in mainland China and cannot be used in any other jurisdictions. Apple may update the scope of Services you can purchase using your Associated Balance by modifying the Services terms and conditions. Any purchase of content or other services from Services using the Associated Balance only be refunded to the Associated Balance when such refund is granted. Unused balances are not transferable.

If you choose to delete your Apple Account, you must spend your Associated Balance prior to closing the account.

Risk of Loss: Apple is not responsible for lost or stolen Associated Balances, including but not limited to the loss, termination, or theft of your Account or your associated payment accounts, or your wilful misconduct or negligence.

Apple reserves the right to close Accounts and request alternative forms of payment if your Associated Balance is used fraudulently, unlawfully, or in connection with misconduct.

Limitation of Liability; Disclaimer of Liabilities APPLE AND ITS LICENSEES, AFFILIATES, AND LICENSORS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE ACCOUNT AND SERVICES, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THESE LIMITATIONS MAY NOT APPLY TO YOU. CERTAIN LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY ALSO HAVE ADDITIONAL RIGHTS.

Waiver and Indemnity BY USING YOUR ASSOCIATED BALANCE OR THE SERVICES, YOU AGREE, TO THE EXTENT PERMITTED BY LAW, TO INDEMNIFY AND HOLD APPLE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND LICENSORS HARMLESS WITH RESPECT TO ANY CLAIMS ARISING OUT OF YOUR BREACH OF THESE TERMS AND CONDITIONS, YOUR USE OF THE ASSOCIATED BALANCE OR THE SERVICES, OR ANY ACTION TAKEN BY APPLE AS PART OF ITS INVESTIGATION OF A SUSPECTED VIOLATION OF THESE TERMS AND CONDITIONS OR AS A RESULT OF ITS FINDING OR DECISION THAT A VIOLATION OF THESE TERMS AND CONDITIONSHAS OCCURRED. YOU AGREE THAT YOU SHALL NOT SUE OR RECOVER ANY DAMAGES FROM APPLE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND LICENSORS AS A RESULT OF ITS DECISION TO REMOVE OR REFUSE TO PROCESS ANY INFORMATION, CONTENT OR OTHER SERVICES, TO WARN YOU, TO SUSPEND OR TERMINATE YOUR ACCESS TO THE SERVICES, OR TO TAKE ANY OTHER ACTION DURING THE INVESTIGATION OF A SUSPECTED VIOLATION OR AS A RESULT OF APPLE'S CONCLUSION THAT A VIOLATION OF THESE TERMS AND CONDITIONSHAS OCCURRED. THIS WAIVER AND INDEMNITY PROVISION APPLIES TO ALL VIOLATIONS DESCRIBED IN OR CONTEMPLATED BY THESE TERMS AND CONDITIONS.

Governing Law: These Terms and Conditions, and the relationship between you and Apple shall be governed by the laws of the State of California, excluding its conflict of laws provisions. You and Apple agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, to resolve any dispute or claim arising from these Terms and Conditions.

Specifically excluded from application to these Terms and Conditions is that law known as the United Nations Convention on the International Sale of Goods.

PROMOTIONAL PROGRAMS

From time to time, we may, in our sole discretion, run promotional programs associated with the Associated Balance (“Promotions”).

Terms and Conditions of a promotion may be changed or modified at any time without notice to you.

Customers who add funds to their Associated Balance during a Promotion in Mainland China may be eligible to receive a monetary bonus (“Bonus”) upon adding funds into your Associated Balance in the Services during the promotional period.

Promotion Period: Bonuses are only available during the promotional period, as defined by the Promotional terms and conditions, and while supplies last. You must be an individual end user located in Mainland China to obtain the Bonus and Apple reserves the right to deny the Bonus to end users located outside Mainland China. Apple may modify or end a Promotion at any time, for any reason.

Bonuses received as a result of a promotion are promotional and have no cash value.

Bonuses are subject to the terms and conditions of Apple Account Associated Balance and the Services. Bonuses are not redeemable for cash or eligible for exchange.

Promotional Terms and Conditions do not alter, in any way, the terms and conditions of the Services or the Apple Account Associated Balance.

Your bonus is personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose.

This offer is void where prohibited or restricted by law.
