1. Terms and Conditions for Recycling Service

The recycling service for products is provided by Jiaxing iFengPai Commerce Co., Ltd. (“iFengPai”) through Apple Trading (Shanghai) Co., Ltd./Apple Electronics Products Commerce (Beijing) Co., Ltd. and its designated affiliates, subsidiaries and branches (collectively “Apple”) at no cost to customers. To the extent permitted by applicable law, Apple hereby disclaims and excludes any and all warranties of any kind, express or implied.

“Recycling Service” means the reuse of the product or its parts which is undertaken by iFengPai.

“Customer” means the undersigned owner of the product.

“Product” means iPhone or iPad or such other eligible Apple products as determined by iFengPai and Apple from time to time for the purposes of the Recycling Service.

 

2. Eligible Device

“Eligible Device” means any device that is eligible for this Recycling Service as determined by iFengPai and Apple in their sole discretion. Device locked to a carrier is illegible for this Recycling Service. iFengPai and Apple reserve the right to reject any carrier locked device for this Recycling Service. 

 

3. Apple Is an Agent of iFengPai

The Customer understands, acknowledges and agrees that Apple is acting as an agent for iFengPai and that Apple is only collecting the Eligible Device on behalf of iFengPai.

 

4. The Customer as the Owner of the Eligible Device Represents and Warrants That:

4.1 He/she is the sole owner of the Eligible Device and is legally entitled to sell and dispose such Eligible Device; there are not any liens, encumbrances or security interests in or attached to the Eligible Device. 

4.2 He/she is not an Apple reseller.

4.3 He/she is at least 18 years old. 

 

5. Ownership Transfers to iFengPai

Upon Apple receiving and accepting the Eligible Device, ownership of that Eligible Device transfers to iFengPai, and the Customer acknowledges that he/she disclaims any right and  interest to the Eligible Device and any items contained therein, including without limitations, the right of ownership and the right of disposal. 

 

6. Purchase of New Product

6.1 Apple, acting as an agent for iFengPai, will advise the Customer of the assessed value of his/her Eligible Device and obtain the confirmation with the Customer's signature. 

6.2 This is the value Apple will on behalf of iFengPai pay the Customer for the Eligible Device.

6.3 iFengPai makes no representation and warrant (express or implied) about the market value of the Eligible Device or the price the Customer may be able to obtain elsewhere. 

6.4 The Customer agrees that the value received for the Eligible Device will be used towards the outright purchase of a new Product.

7. Return and Refund

The Customer may return the new Product in its original and undamaged condition, together with the original proof of purchase, Fapiao and the original package, within 14 days of his/her purchase. If returned within the first 7 days of purchase, Apple will return to the Customer his/her original device and refund the balance the Customer actually paid toward the purchase of the new Product. If returned more than 7 days after purchase, the Customer may choose to receive the balance he/she actually paid for the purchase of the new Product, or exchange his/her new Product for a different Product at the same value or higher.

 

8. General Terms and Conditions

This Recycling Service is provided for lawful purposes only, and the Customer understands and agrees that: 

8.1 He/she has sole responsibility for keeping a separate backup copy of any files or data contained in the Eligible Device before transferring ownership of the same to iFengPai. The Customer shall take reasonable steps to remove files and data that are deemed personal or confidential. The Recycling Service does not include data and files recovery or removal. Apple and iFengPai accept no responsibility or liability for any lost data or files.

8.2 The Customer is responsible for ensuring that the SIM card is removed from the Eligible Device. iFengPai and Apple are not responsible for any loss arising from any failure to remove the SIM card.

 8.3 The Customer must ensure that the Eligible Device is legally obtained. The Customer shall not provide iFengPai or Apple with any Eligible Device obtained through illegal means, such as stealing, robbery, fraud, counterfeit or smuggle, or any Eligible Device that the Customer has no right of disposal. The Customer shall provide the ID card and some other relevant information to prove that the Eligible Device has been legally obtained. The Customer shall be solely liable for any civil, criminal or administrative liabilities in connection with any dispute due to the fact that the Eligible Device was illegally obtained or the Customer had no right of disposal, and iFengPai and Apple have the right to claim for indemnity from the Customer for any relevant loss. iFengPai may turn in the suspected Eligible Device to relevant law enforcement authorities and cooperate with the authorities in any investigation, if it finds that there is any suspected illegal conduct. 

8.4 Only one Eligible Device is allowed in each transaction and the Customer will receive the corresponding value. The value can only be used to purchase one new device. The value of the Eligible Device should not exceed the value of the new device. 
8.5 As provided under laws and the orders and requirements of the law enforcement authorities or administrative authorities, it may be legally necessary to provide to the law enforcement and other relevant authorities the unique numeric identifier of the Customer’s Eligible Device and such Customer’s personal information.

8.6 The Customer shall be responsible for indemnifying Apple and iFengPai and any of their directors, officers, employees, affiliates, subsidiaries, branches or agents from and against any losses they incurred as a result of their performing their obligations under the Recycling Service, or any breach of this Terms and Conditions by the Customer.

8.7 iFengPai has the right to cancel the recycling transaction with the Customer under its sole and reasonable discretion if the Customer breaches this Terms and Conditions and return the relevant Eligible Device to the Customer. The Customer agrees to return the value and other relevant benefit (if any) as requested by iFengPai. 

8.8 Information collected by iFengPai will be dealt with in accordance with the iFengPai Privacy Policy, accessible by emailing policy@ifengpai.com.

8.9 iFengPai and Apple will not be liable for any special, indirect, incidental or consequential damages resulting from the Recycling Service. To the extent permitted by law, iFengPai and Apple’s entire liability, if any, from any cause whatsoever with respect to this Recycling Service shall not exceed RMB 50.

8.10 The Recycling Service may not be available in all Apple business areas and locations. Apple and iFengPai may reject, cancel, suspend or restrict the Recycling Service if it is prohibited or restricted by applicable law. 

8.11 iFengPai and Apple reserve the right to refuse, cancel or restrict the Recycling Services under any circumstances without any liabilities.

8.12 The Recycling Service is not redeemable and has no cash value.

 

9. Governing Law and Dispute Resolution

This Terms and Conditions shall be governed by the laws of the People’s Republic of China. Any dispute with respect to the interpretation and execution of this Terms and Conditions shall be settled through friendly consultation by the parties. If the dispute cannot be resolved through consultation, either party may submit the relevant dispute to Shenzhen Court of International Arbitration for arbitration.
