Apple Trade In

This Trade-in Service for Eligible Devices is provided by Softbank C&S. ("SoftBank") and Apple Inc., and any of its affiliates and subsidiaries (collectively, "Apple") at no cost to Customers.

"Eligible Device" means any device that is eligible for this Trade-in Service as determined by SoftBank in its sole discretion.

"Trade-in Service" means the responsible reuse or recycling of the Eligible Device or its parts.

"Customer" means the person agreeing to these Terms & Conditions.

Customer understands, acknowledges and agrees that Apple is acting on behalf of Softbank and that Apple is only collecting the Eligible Device on behalf of Softbank.

Customer represents and warrants that it is the sole owner of the Eligible Device or has been authorized by the owner of the Eligible Device to make decisions on the Eligible Device and there are no liens, encumbrances or security interests in or attached to the Eligible Device and that no other party has a legal interest in it.

Upon Customer's receipt of value for an Eligible Device from Apple in the form of a Gift Card, title of ownership then transfers from the customer to SoftBank via Apple and Customer disclaims any further right, title or interest in and to such Eligible Device (and any data contained therein) and assigns to Apple the right to collect from SoftBank the value for such Eligible Device.

Customer agrees that it has the sole responsibility to keep a separate back up copy of any files or data before transferring ownership of its Eligible Device; and that the Customer has taken reasonable steps to eliminate and delete files and data that are deemed personal or confidential.

By utilizing this Trade-in Service, Customer releases Apple and SoftBank from any claim or liability for any lost files or data, or failure to maintain the integrity or confidentiality of any files or data.

Customer represents and warrants that they are not a reseller of Apple products and any items Customer seeks to recycle through the Trade-in Service shall not: (1) infringe on any third-party intellectual property right (including copyright, trademarks, patent, trade secrets or other proprietary right); or (2) be counterfeit, stolen, or fraudulent.

This Trade-in Service is provided for lawful purposes only, and the Customer agrees to indemnify Apple and SoftBank and any of its directors, officers, employees, affiliates, subsidiaries or agents from and against any claims brought against any of them arising from performing this Trade-in Service on Customer's behalf or for any breach of these terms and conditions by Customer.

SoftBank and Apple will under no circumstances be liable for any special, indirect, incidental or consequential damages resulting from this Trade-in Service. 

To the extent permitted by applicable law, SoftBank, Apple, and its affiliates’ entire liability, if any, from any cause whatsoever with respect to this Trade-in Service shall not exceed ¥5000.

This Trade-in Service is void where prohibited or restricted by law and may not be available in all Apple locations.

SoftBank and Apple reserve the right to refuse, cancel or limit Trade-in Services for any reason or with respect to any device and may change these terms and conditions at any time without notice.

The Trade-in Service is not redeemable and has no cash value.

Customer understands and agrees that the Eligible Device’s unique numeric identifier provided under this Trade-in Service may be checked against a national lost/stolen device database, and such identifier, as well as any personal information provided by Customer under this Trade-in Service, may be provided to law enforcement.

Customer understands that final value of the product is dependent on the condition and type of product.

Customer understands and agrees that they must be 20 or over to participate in this Trade-in Service.
